Use of the website
By using this Website, you confirm that you are at least 18 years of age and have the legal authority to enter into this agreement and to use the Website in accordance with these Terms of Use. If you are making travel reservations or bookings on behalf of another person, you agree to inform them of all applicable terms, conditions, rules, and restrictions, including these Terms of Use. You accept full financial responsibility for all activities conducted through your account or under your direction. You also ensure that all information provided by you, on your behalf, or by any member of your household is truthful, accurate, complete, and current. Additionally, you confirm that the traveler is not an unaccompanied minor.
Your Holiday Contract
By making a booking, the ‘lead name’ confirms that they have the authority to accept, and do accept, these booking conditions on behalf of all members of the party. Once we receive your booking request along with the applicable payments, and provided the requested arrangements are available, a confirmation invoice will be issued. A binding agreement is established once this invoice is sent to the ‘lead name’ or your Tour Operator/Travel Agent.
It is your responsibility to carefully review the invoice upon receipt—or, in the case of late bookings, to verify the details at the time of booking—to ensure that all information is accurate and as requested. Should there be any discrepancies, please notify us or your Tour Operator/Travel Agent immediately, as changes may not be possible at a later stage.
Website accuracy
While AVD takes every care to ensure the accuracy of the information and pricing on this website, occasional errors may occur. Therefore, it is essential that you confirm the price and all relevant details of your selected arrangements with us at the time of booking.
Passports, visas, health requirements and travel documents
It is your responsibility to ensure that you possess all required travel and health documents prior to departure. A valid passport is mandatory for all destinations we offer, including for children, and visas may be necessary for certain international travel. As entry requirements can change, it is essential that you verify the latest information well in advance of your departure.
By using our services, you acknowledge that AVD acts solely as a facilitator in the visa application process and is not liable for any outcomes related to the application, including delays, additional documentation requests, or rejections issued by the embassy or consulate.
Insurance
We strongly recommend that all travelers have adequate travel insurance in place and carry proof of coverage while on holiday. It is your responsibility to ensure that the policy you choose provides appropriate and sufficient protection for your specific needs. AVD shall not be held liable in cases where entry is denied due to a guest’s failure to present valid insurance documentation or for any other reason. If you decide to travel without adequate insurance, you do so at your own risk, and AVD will not be responsible for any losses or expenses that would have been covered under a suitable insurance policy.
Paying for Your Holiday
To confirm your selected travel arrangements, you may either make a full payment or a partial payment, as determined by your Tour Operator. If opting for a partial payment, a minimum of 30% of the total cost is required at the time of confirmation, with the remaining 70% due no later than 7 days prior to arrival. Your payment secures specific services such as flights, tours, and ground transportation, which will be confirmed at the time of booking.
If the full balance is not received by the specified due date, AVD reserves the right to consider the booking cancelled by you, and cancellation charges as outlined in Clause 9 will apply. Any cancellation fees, processing charges, booking amendment fees, and insurance premiums become payable immediately upon invoice issuance.
Travel documents will be issued within 3 days of receiving the initial 30% payment. For bookings made within 15 days of arrival, full payment is required immediately upon receiving written confirmation.
We accept payments via credit card, debit card, internet banking, and direct transfers to our designated bank accounts.
Convenience Fees
Convenience fees will apply to all payments made after the initial booking date, except for payments made via direct bank transfer. We reserve the right to revoke any waiver of convenience fees for payments made on the day of booking.
Credit Card Fraud Contingency:
Failure to provide accurate billing information or cardholder details for your credit or debit card may result in delays in ticket issuance and could lead to increased costs. We reserve the right to cancel your booking if a payment is declined or if incorrect card information is provided.
To help prevent credit card fraud, we may conduct random security checks. In such cases, prior to ticket issuance, you may be asked to submit proof of address, a copy of your credit card, and a recent statement via fax or mail.
Your Holiday Price
AVD strives to display the most accurate and up-to-date pricing on our website. However, we reserve the right to adjust prices at any time, whether upward or downward. In rare instances, a pricing error may occur. If such an error is identified, we will make every effort to inform you at the time of booking (if known then) or as soon as reasonably possible thereafter. Should you choose not to accept the correct price, AVD reserves the right to cancel the booking without liability.
If You Change Your Booking
If you wish to modify your travel arrangements after receiving the confirmation invoice, we will make every effort to accommodate your request; however, changes may not always be possible. All change requests must be submitted either by the ‘lead name’ on the booking or through your Tour Operator to AVD.
Please note that the closer the request is made to the departure date, the higher the potential cost of changes. Only one departure date change is allowed per booking, and such a change may be treated as a cancellation, with applicable cancellation charges imposed.
Important: Certain travel arrangements may be non-amendable once confirmed. In such cases, modifications may incur cancellation fees of up to 100% of the affected services. You may also be required to cover the full cost of rebooking new arrangements.
If You Cancel Your Holiday
You, or any member of your group, may cancel your travel arrangements at any time. To do so, we must receive written notice from the ‘lead name’ on the booking or your Tour Operator, submitted via mail, fax, or email.
Please note: If your reason for cancellation is covered under your travel insurance policy, you may be eligible to recover the associated costs from your insurance provider.
Our cancellation fees are calculated as a percentage of the total holiday cost and are determined based on the date we receive your cancellation notice—not the date it was sent.
Please be aware that amendment fees are non-refundable.
If only certain members of your group cancel, the applicable cancellation charges will apply to those individuals, and we will recalculate the total holiday cost for the remaining travelers. This may result in additional charges, such as single room supplements.
In some cases, if our suppliers impose cancellation fees that exceed the original deposit amount, we reserve the right to pass those additional costs on to you. For complete details, please contact us, and we will inform you of the specific charges related to your booking.
If We Change or Cancel Your Holiday
Our Tour Operators begin planning travel arrangements well in advance, and as such, we reserve the right to make changes to, or correct errors in, the holiday details both before and after your booking is confirmed. We also reserve the right to cancel confirmed bookings at any time if necessary.
While most changes are minor, there may be rare instances where a Major Change is required. In such cases, we will inform you as soon as possible, and if time permits before departure, you will be given the following options:
- Accept the revised arrangements; or
- Choose an alternative holiday of a similar standard, if available.
- If the alternative is less expensive, we will refund the difference.
- If it is more expensive, you will be required to pay the additional amount.
Mode and Duration of Refund(s)
Once a refund is initiated from our system, it typically reflects in your account within 3–4 working days, though in some cases it may take up to 21 working days. Refunds will be processed only to the original method of payment.
If a refund to the original payment method is not possible, it may be processed to the buyer’s bank account. In such cases, verification (KYC) and proof of account ownership will be required, and the verification process may take between 7–15 working days.
For PayPal transactions older than 60 days, refunds will be issued exclusively to the PayPal-linked email ID used for the original payment (this is the fastest method). Exceptions may be reviewed on a case-by-case basis; however, we do not support cross-currency refunds, i.e., refunds will be made in the same currency as the original transaction.
Behaviour
By booking a holiday with AVD, you agree to take full responsibility for your own conduct and that of your travel companions throughout the trip. Should AVD or any authority figure determine that you or any member of your party is acting in a manner that poses a risk, causes distress to others, or results in damage to property, we reserve the right to immediately terminate the holiday arrangements of the individual(s) involved.
In such cases, the affected person(s) will be required to vacate the accommodation or service, and AVD will bear no further responsibility, including arranging return travel. No refunds will be issued, and any additional expenses incurred due to the termination will be the sole responsibility of the individual(s) involved.
You will also be liable for the full cost of any damage or loss caused by you or your party during the trip. This payment must be made directly to the service provider at the time. If not settled immediately, you will be held accountable for any subsequent claims made against AVD, including all associated legal costs for both parties.
If You Have A Complaint
If you encounter any issues or have a reason to complain during your holiday, it is essential that you report the matter immediately to your Tour Operator’s representative, AVD, and the relevant service provider. A report form should be completed on-site at the resort.
Most concerns can be resolved promptly while you are still on holiday. However, if the issue remains unresolved, please contact us by phone or email at admin@absolutevietnamdmc.com within 7 days of your return. Be sure to include your booking reference, a clear description of your complaint, and any relevant details. Keeping your communication concise will help us address your concerns more efficiently and ensure a timely response.
Our Liability To You
In respect of Packages
We guarantee that your holiday arrangements will be planned, executed, and delivered with reasonable skill and care. This means we accept responsibility if any part of your booked services is not provided as promised due to a failure on our part—or that of our employees—to exercise appropriate care in arranging or delivering those services.
In respect of other arrangements
We are committed to exercising reasonable skill and care in fulfilling our contractual obligations, in accordance with these Booking Conditions. Our responsibilities include using such care and skill in processing your booking, arranging your accommodation, flights, or car hire, and in the selection of the suppliers we work with.
In respect of Packages and other arrangements
We are not liable for any injury, illness, death, loss, damage, expense, cost, or other claims of any kind that arise from:
- The acts and/or omissions of the affected individual(s) or any member(s) of their party; or
- The acts and/or omissions of a third party not involved in the delivery of your travel arrangements, where such events were unforeseeable or unavoidable.
Except as expressly outlined in these Booking Conditions, our liability is limited to that imposed under the applicable Package Travel, Package Tours, and Package Holidays Regulations. If you wish to bring a claim against us, it is your responsibility to demonstrate that reasonable skill and care were not exercised.
Local Excursions/Activities/Events
We cannot accept responsibility for any services or facilities that are not included in your confirmed booking with us or not advertised on our website. This includes, for example, any excursions, tours, or activities you may choose to book independently while on holiday, or any additional services offered directly by your hotel or another supplier.
Such excursions, activities, or events booked separately—whether through a third party or arranged locally while on your trip (“Local Events”)—are not part of the holiday package provided by AVD or its Tour Operators. Accordingly, our terms and conditions do not apply to these services. Your agreement for any Local Event will be directly with the third-party supplier, and we assume no responsibility for its delivery or for any issues that may arise during its course. This exclusion also applies to all hazardous or high-risk activities.
The services and facilities included in your holiday package will be considered to have been provided with reasonable skill and care if they comply with the applicable local regulations. Where no such regulations exist, the service will be assessed against local industry standards in practice.
Data protection/privacy
To process your booking and fulfill your travel requirements, we will need to share your personal information with the relevant suppliers involved in your travel arrangements. Additionally, we may retain your details (including your email address, if provided) for future marketing purposes, such as sending you promotional offers, competition updates, or our brochure on behalf of AVD.
If you prefer not to receive such communications, you may update your preferences at any time through our website. For comprehensive information on how we collect, use, and protect your personal data, please refer to our Privacy Policy.
Special requests and medical problems
If you have any special requests, please ensure they are communicated to us at the time of booking. While we will do our best to forward all reasonable requests to the relevant supplier, we cannot guarantee that they will be fulfilled. The inclusion of a special request on your confirmation invoice or any other correspondence, or the fact that it has been relayed to the supplier, does not imply that it will be met. Unless a request has been specifically confirmed in writing, failure to fulfill it will not be considered a breach of contract on our part.
We are always happy to assist you in selecting a holiday that suits your needs. Please note that some accommodations or resorts may not offer basic accessibility features such as ramps, elevators, or adapted facilities. If you or any member of your party has a disability or specific requirement, it is essential that you inform us at the time of booking. This allows us to ensure the chosen arrangements are suitable.
If we believe we are unable to adequately meet the needs of the individual(s) concerned, we reserve the right to decline the booking. If complete details are not provided at the time of booking and we later determine we cannot accommodate the requirements, we may have to cancel the booking.

General Limitation of Liability
To the fullest extent permitted by law, AVD shall not be liable to any individual or entity for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages of any kind. This includes, but is not limited to, losses arising from:
- loss of profit, revenue, contracts, production, goodwill, reputation, or data; business interruption; inconvenience, stress, or distress;
- inability to access or use the website, or delays, performance failures, or unauthorized use;
- unauthorized access to, or alteration of, personal data or communications;
- failure of third-party suppliers (e.g., airlines, hotels, transport providers) to deliver promised services or products;
- inaccuracies, errors, or outdated information presented on the Site, including rates, availability, and descriptions of services;
- transactions conducted through the Site;
- damage to property (including systems and devices) caused by viruses or other harmful elements during Site use;
- use or inability to use the Site, or reliance on any content, products, or services obtained through it;
- personal injury, death, or property damage related to the actions or omissions of travel service providers and their representatives;
- any damages resulting from force majeure events.
Force Majeure
AVD shall not be held liable for any failure or delay in performance due to circumstances beyond its control ("force majeure"). Such events include, but are not limited to: natural disasters, severe weather, fire, war, riots, terrorist acts, government actions, pandemics, labor disputes, system failures, or internet/network disruptions.
In such instances, AVD is not obligated to offer refunds or compensation for delays, cancellations, overbookings, rerouting, or additional expenses incurred. Furthermore, AVD disclaims any liability for breaches of contract, negligence, or warranties (including merchantability or fitness for a particular purpose) by carriers, hotels, or other third-party service providers.
Prohibited Activities
The content and information on this website—including but not limited to pricing, availability of travel services, and the underlying infrastructure used to provide such content—are the proprietary property of AVD or its suppliers and service providers.
You may make limited copies of your travel itinerary and related documents for personal use in connection with bookings made through this website. However, you agree not to:
- Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or resell any content, software, products, or services obtained from or through this website without prior written consent.
- Make any speculative, false, or fraudulent booking, or any reservation made in anticipation of demand.
- Use any automated system (e.g., robot, spider, scraper) or manual process to access, monitor, or copy content from this website without express written permission.
- Bypass any security measures or restrictions set in place, including those contained in our robots.txt file.
- Take any action that places an unreasonable or disproportionately large load on our website infrastructure.
- Copy, reproduce, display, frame, mirror, download, print, publish, or distribute website content for commercial purposes without written authorization from AVD.
- Attempt unauthorized access to the website, its systems, accounts, networks, or any related infrastructure through hacking, password mining, or other intrusive methods.
- Manipulate or forge headers or other identifiers to disguise the origin of any data submitted through the website.
- Use the website in any way that may damage, disable, impair, or interfere with its proper functioning or that of any other user or system.
- Engage in any conduct that may harm the Site, AVD, its employees, reputation, or its users, or that may violate any applicable laws or regulations.
Fraudulent Activity
If we detect any signs of fraud, abuse, or suspicious activity related to your bookings or account—including but not limited to multiple bookings using the same email address or account—we reserve the right to cancel those reservations and deactivate any associated accounts. In cases of confirmed fraud, we may pursue legal action, and you may be held liable for resulting financial losses, including legal fees and damages.
Jurisdiction and Applicable Law
These Terms & Conditions, along with any related agreements, shall be governed by and interpreted in accordance with the laws of the courts of Bangalore, India, without reference to conflict of law principles.
All guest claims must be submitted to AVD in writing and received no later than sixty (60) days following the completion of the trip. Claims not submitted within this timeframe will be considered waived and will not be accepted.
